must own the copyright for the sound recordings
or have the authority or permission from the copyright
owner(s).

you didn't write the song/composition you must find
out who the copyright owners are, and contact the publisher
of the song/composition their mechanical royalties the
same way you would for CDs sold, but based on your MP3
download CD sales activity.
If
you have samples in your music, they must all be
legally cleared and paid-for.No "mix
tapes"of other people's music, even if you
are mixing in your own music.
It
is of the utmost important that you have all rights and
permission to your music. Music distributed
on the internet is watched very carefully by lawyers. Consequences
are severe, if you do not abide by music copyright
laws.

is a cover song?

cover song is a recording of a previously recorded
song that you didn't write.

If
you record a cover song, and you intend on selling
it, you are required to contact the music publisher
(the song's copyright owner).

Examples:
You recording your version of an Aerosmith or Eminem
song.
What
is a Music Publisher?
The
publisher is the owner of the copyright of
the song. This is not the recording of the song.
It is the words,
music,
lyrics, melody and/or harmony.
How
do I find the music publisher?
You
can visit ASCAP to check if a song has
a publisher.
The
publishers are usually in the album credits in the original
(or cover) version of a song.
If I have a cover song can I use it?
You
simply need to contact the music publisher and notify
them that you have recorded the cover song.
Researching
your cover songs is of the utmost important to you! The
last thing you want is a lawsuit on your hands.
